Terms and Conditions

These terms and conditions govern the use of the services offered by THE FLOW DANCE SAS(hereinafter "Kchaka Fitness" or "the Academy"), identified with Tax ID (NIT) 901.799.835-0, with registered address at Calle 109 #15-56, Bogotá, Colombia.
By registering, booking a class or purchasing a plan, the user accepts these terms in their entirety.
1. Service Description
Kchaka Fitness is a dance academy offering group classes in various styles (Rumba Fitness, Salsa, Urbano, Champeta and Reggaeton) at its locations in Bogotá, Colombia.
Services include:
- In-person group dance and fitness classes.
- Sale of plans and class packages.
- Online booking system.
2. Registration and Account
- To access the services, the user must provide accurate and complete information: name, identification document, phone number and email address.
- In the case of minors, registration must be carried out by their parent or legal guardian, who assumes responsibility.
- The user is responsible for keeping their information up to date.
3. Plans and Prices
Kchaka Fitness offers the following plans:

- Prices are stated in Colombian pesos (COP) and include VAT where applicable.
- Kchaka Fitness reserves the right to modify prices with prior notice. Plans already purchased will not be affected.
- Plan validity begins from the date of purchase. Classes not used within the validity period are non-accumulable and non-transferable.
4. Payments
- In person: We accept cash, card (debit and credit), Nequi, Daviplata and bank transfer.
- Online: Payments are processed through the Bold payment gateway, authorized by the Colombian Financial Superintendency. Kchaka Fitness does not store card data or banking credentials.
- Payment receipts are generated automatically with a consecutive invoice number.
5. Bookings and Attendance
- Classes have limited capacity. We recommend booking in advance via our online system (kchakafitness.com).
- Mandatory online payment: when booking a class from the website, the user must pay the applicable amount (drop-in or plan) within the same booking flow. Without confirmed payment, the booking is not valid.
- Late arrival grace: bookings remain valid up to fifteen (15) minutes after class start. After that, the spot is released and the user forfeits the booking.
- Kchaka Fitness reserves the right to cancel or modify schedules for operational reasons or force majeure.
6. Cancellation, No-show and Rescue Policy
- On-time cancellation: users may cancel a booking at least two (2) hours before class start with no penalty.
- Late cancellation or no-show:if the user cancels within the 2-hour window, doesn't show up, or arrives more than 15 minutes after class start:
- If booked with a class-pack or paid drop-in, that class is consumed — no credit refund, no payment refund.
- If booked with an unlimited monthly or longer plan, no credit deduction applies. Kchaka Fitness reserves the right to introduce additional policies for repeated no-shows on unlimited plans, with prior notice.
- Reusable credit: when the user cancels a paid drop-in on time, that payment becomes a credit usable for any class within the next 30 calendar days. Unused credits expire after that period.
- Late-arrival rescue: users have one (1) rescue per calendar month. If a booked class is missed due to late arrival or absence, the user may transfer that booking to another class on the same day (subject to availability) at no extra charge. Rescue is activated from the booking modal when selecting the new class. Only one rescue per month; subsequent no-shows in the same month consume the credit or payment as usual.
- In duly proven force majeure, the user may request a temporary plan freeze. Requests must be submitted in writing to reception and are subject to approval.
- Kchaka Fitness does not issue cash refunds. Pending credits remain usable within the validity of the applicable plan.
7. User Conduct
By using Kchaka Fitness services, the user agrees to:
- Respect teachers, administrative staff and other users.
- Attend wearing appropriate sportswear and sneakers.
- Follow staff instructions during classes.
- Not attend under the influence of substances that alter behavior.
- Take care of the academy's facilities and equipment.
Kchaka Fitness reserves the right to restrict access to anyone who fails to comply with these conduct rules.
8. Liability and Health
- Participation in classes is voluntary and at the user's own responsibility.
- The user declares to be in adequate physical condition to practice physical activity. In case of pre-existing medical conditions, the user must inform the teacher before class.
- Kchaka Fitness is not responsible for injuries resulting from exercise when the user has not disclosed prior medical conditions.
- Minors participate under the responsibility of their parent or legal guardian.
9. Intellectual Property
- The "Kchaka Fitness" brand, logos, designs, website content and graphic material are the property of The Flow Dance SAS.
- Reproduction, distribution or commercial use without written authorization is prohibited.
10. Use of Image
During classes and events, Kchaka Fitness may take photographs and videos for promotional purposes and for distribution on social media and digital channels. By attending classes, the user authorizes the use of their image for these purposes.
If the user does not wish to appear in such content, they must notify us in advance at info@kchaka.com.
11. Personal Data Protection
The processing of personal data is governed by our Personal Data Processing Policy, in accordance with Colombian Law 1581 of 2012 and its regulatory decrees.
12. Modifications
Kchaka Fitness reserves the right to modify these terms and conditions at any time. Modifications will be published on this page and will take effect upon publication. Continued use of the services after a modification implies acceptance of the new terms.
13. Applicable Law
These terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved in the first instance through direct dialogue between the parties. Failing agreement, the parties will submit to the competent judges and courts of the city of Bogotá.
