Privacy Policy
Processing of personal data in accordance with Colombian Law 1581 of 2012 and Decree 1377 of 2013.
1. Data Controller
Kchaka Fitness is the company responsible for processing personal data collected through its physical facilities, web platform and digital communication channels.

2. Data We Collect
In order to provide our services, Kchaka Fitness collects the following personal data:
- Full name
- Identification number (national ID)
- Email address
- Mobile phone number
- Class attendance data (date, style, location)
- Payment information (plan value, payment method, transaction date)
We do not collect sensitive data as defined by Colombian Law 1581 of 2012.
3. Purposes of Processing
The personal data collected is used exclusively for the following purposes:
- Management and confirmation of class bookings
- Attendance registration and tracking
- Communication about schedules, class changes, plans and service updates
- Billing and payment processing
- Continuous service improvement and internal statistical analysis
- Compliance with legal and accounting obligations
- Booking policy enforcement: by booking a class, the user expressly authorizes Kchaka Fitness to enforce the cancellation and no-show policy described in the v2.0 Terms and Conditions. This includes, without limitation: deducting credits from class-pack plans for unjustified no-shows, retaining drop-in payments for late cancellations, and applying the monthly rescue mechanic when applicable.
4. Legal Basis for Processing
The processing of your personal data is carried out in accordance with Colombian Law 1581 of 2012 (Personal Data Protection Law) and Decree 1377 of 2013 of the Republic of Colombia.
The data subject authorizes the processing of their personal data upon registering as a student at Kchaka Fitness, when booking a class through our digital platform, or when entering into any type of contract or agreement with us.
5. Rights of the Data Subject
As the owner of your personal data, you have the following rights at any time:
- Access the personal data that Kchaka Fitness holds about you
- Update your information when it has changed
- Rectify inaccurate, incomplete or misleading data
- Delete your data when it is no longer necessary for the purposes of processing
- Revoke the authorization granted for the processing of your data
- File complaints with the Superintendency of Industry and Commerce (SIC) when you consider your rights have been violated
6. How to Exercise Your Rights
To exercise any of the rights described in this policy, the data subject must send a written request to the email address info@kchakafitness.com, indicating:
- Full name of the data subject
- National ID number
- Clear description of the request and the right being exercised
- Contact details to receive a response
Kchaka Fitness will respond to your request within ten (10) business days following the date of receipt. If the request cannot be handled within that timeframe, you will be notified in due course with the estimated response date.
7. Data Retention
Personal data will be retained for as long as there is an active contractual or service relationship between the data subject and Kchaka Fitness. Once such relationship has ended, data will be retained only for the time required by Colombian law for accounting, tax or legal purposes.
Once the applicable retention period has elapsed, the data will be securely deleted from our systems.
8. Security Measures
Kchaka Fitness has adopted technical, human and administrative measures to protect data subjects' personal data against unauthorized access, loss, alteration, disclosure or destruction.
Access to personal data is restricted to authorized Kchaka Fitness personnel who require it for the performance of their duties. Such personnel are bound by confidentiality obligations.
9. Changes to this Policy
Kchaka Fitness reserves the right to update or modify this Privacy Policy at any time. Any relevant changes will be communicated to data subjects through our official communication channels.

10. Effective Date
This Privacy Policy is effective as of January 1, 2025.
